Coronavirus Absolute Exclusion

Our insurers issued us with this statement yesterday 12th March 2020

 Notwithstanding any other provision (including any communicable disease extension), no cover is provided under this policy for any claim, loss, cost or expense of whatever nature directly or indirectly arising out of, contributed to by or resulting from coronavirus disease (COVID-19), severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2), or any mutation or variation thereof.

 This exclusion also applies to any claim, loss, cost or expense of whatever nature directly or indirectly arising out of, contributed to by or resulting from:

 (i)            any fear or threat (whether actual or perceived) of; or
(ii)           any action taken in controlling, preventing, suppressing or in any way relating to any outbreak of;
coronavirus disease (COVID-19), severe acute respiratory syndrome coronavirus 2 (SARS-CoV-2), or any mutation or variation thereof.’
So basically, all Instructors declared from 12/03/2020 onward will not be covered for liability arising from the virus.
The cover you have is a third party legal liability policy, so a claimant will have to prove negligence against you to be successful in claiming compensation.

As an Association, it might be prudent to issue a notice to all your Instructors quoting the Government Guidelines for schools, ie do not attend class if you have a fever, dry cough or a shortness of breath, regularly wash hands etc.  It might also be prudent in some cases to reduce or ban contact – perhaps practice forms or work on fitness. Shared equipment should be sanitised after each use or maybe taken out of use until this calms down.
